Welcome to Sinternet Cult (“we,” “us,” “our”). We operate this online store and website, including all related information, content, features, tools, products, and services (collectively, the “Services”). Our store is powered by Shopify. These Terms of Service (the “Terms”), together with any referenced policies (including our Privacy Policy and Refund Policy), describe your rights and responsibilities when using the Services.
Section 1 – Access and Account
You represent you are at least the age of majority in your state/province of residence and consent to allow any minor dependents to use the Services on devices you own or manage. You may be asked for information such as your email address, billing, payment, and shipping details. You warrant all information is accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activity under your account. You may not transfer, sell, or license your account.
Section 2 – Our Products
We make every effort to present products accurately. Actual colors and appearance may vary due to screens/settings. We do not warrant that product quality or fit will meet expectations. Descriptions, pricing, and availability may change without notice. We may discontinue products or limit quantities at our discretion.
Section 3 – Orders
Your order is an offer to purchase. Orders are accepted once payment is processed and we confirm acceptance. We may decline or modify orders at our discretion. Purchases are subject to our Refund Policy. Purchases are for personal/household use only, not resale or export.
Section 4 – Prices and Billing
Prices, discounts, and promotions may change without notice. The charged price is the one in effect when your order is placed. Posted prices exclude taxes, shipping, or import charges unless stated. You agree to provide current and accurate account/payment info. You warrant authorization to use your payment method and agree to pay all charges.
Section 5 – Shipping and Delivery
Made-to-Order: Production takes 2–5 business days. Transit (U.S. only): Most orders arrive in 3–7 business days after production. Delivery times are estimates, not guarantees. Risk of Loss: Title and risk transfer once we hand items to the carrier. Shipping Area: We currently ship within the U.S. only.
Section 6 – Intellectual Property
All site content (trademarks, logos, text, images, audio/video, reviews, design) is owned by Sinternet Cult or licensors, protected by law. Use is limited to personal, non-commercial purposes. No reproduction/distribution without written consent. Our names/logos are trademarks of Sinternet Cult. Shopify’s marks belong to Shopify. Other marks belong to their owners.
Section 7 – Optional Tools
We may provide access to third-party tools “as is” and “as available,” without warranties or endorsements. Use at your own risk and subject to third-party terms.
Section 8 – Third-Party Links
The Services may contain third-party content or links. We do not control and are not responsible for such content/sites. Use at your own risk and subject to their terms.
Section 9 – Relationship with Shopify
Sinternet Cult is powered by Shopify. Sales are made directly with us. Shopify is not responsible for purchases. You release Shopify from claims related to your transactions with us.
Section 10 – Privacy Policy
Personal information collected is subject to our Privacy Policy and Shopify’s privacy practices. Because Shopify hosts the Services, information may be processed by Shopify or third parties (possibly outside your jurisdiction).
Section 11 – Feedback
By submitting feedback (ideas, reviews, suggestions), you grant us a perpetual, royalty-free license to use, reproduce, modify, and distribute it for any purpose. You represent you own the rights to the feedback and that it complies with these Terms.
Section 12 – Errors, Inaccuracies, and Omissions
We may correct errors or omissions (including in pricing, product descriptions, or shipping estimates) and update information at any time without notice.
Section 13 – Prohibited Uses
You may not use the Services for unlawful purposes, to violate rights, harass, spread malicious content, send spam, impersonate others, collect personal info without consent, upload malware, or interfere with the site. We may suspend or terminate access for violations.
Section 14 – Termination
We may suspend or terminate Services at any time with or without notice. You remain liable for charges incurred up to termination. Sections meant to survive termination will continue to apply.
Section 15 – Disclaimer of Warranties
Except as expressly stated by Sinternet Cult, the Services and products are provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant uninterrupted, secure, or error-free Services.
Section 16 – Limitation of Liability
To the fullest extent permitted by law, Sinternet Cult, Shopify, and affiliates are not liable for indirect, incidental, or consequential damages (including lost profits or data). Our aggregate liability shall not exceed the purchase price of the product.
Section 17 – Indemnification
You agree to indemnify and hold harmless Sinternet Cult, Shopify, and affiliates from claims, damages, and expenses arising from your breach of these Terms, violations of law, or misuse of the Services.
Section 18 – Severability
If any provision of these Terms is found unlawful or unenforceable, the rest remain in effect.
Section 19 – Waiver; Entire Agreement
Failure to enforce a right is not a waiver. These Terms and posted policies are the entire agreement between you and Sinternet Cult, superseding prior agreements.
Section 20 – Assignment
You may not assign these Terms without our written consent. We may assign them without notice.
Section 21 – Governing Law
These Terms are governed by Florida law. You consent to the jurisdiction of state and federal courts in Orange County, Florida.
Section 22 – Headings
Headings are for convenience only and do not affect interpretation.
Section 23 – Changes to Terms of Service
We may update these Terms at any time by posting changes. Material changes will be communicated as required by law. Continued use of the Services after changes constitutes acceptance.
